How to Get a Divorce in Scotland

In Scotland, divorce is not about who is at 'fault' or 'to blame' for the relationship breaking down. Rather than showing one party is to blame, all you must establish is that the marriage has, indeed, broken down irretrievably. The main ways to do this are to show that: It is unreasonable, based on one party’s behaviour, for the marriage to continue; or You both agree to separate and have lived separately for one year. What if One Party Does Not Want the Divorce?

If your spouse does not consent to a divorce, you can seek a divorce after you have lived apart for two years. Our family lawyers can explain how the divorce process works in more detail if the divorce is non-consensual.

What Happens to Your Property When You Get a Divorce?

Property acquired during the marriage, known as 'matrimonial property', must be divided between both parties. This does not always mean an equal split, but rather what is fair and reasonable in the circumstances. Both parties are obliged to provide a breakdown of their property, including income, assets, and debt. The family court will determine how to divide this property based on factors including avoiding serious financial hardship, childcare costs, and avoiding unreasonable financial advantage or disadvantage.

What About Property Acquired Before the Marriage?

If you have property that predates your marriage, then that property is yours alone. It is not considered a matrimonial asset and does not form part of the divorce settlement.

Debts acquired before the marriage are your own responsibility, or your ex-partner’s responsibility. Debts acquired during the marriage should be split in a fair and reasonable way to ensure that both parties take responsibility for the debt, as far as they are able.
